Apple looking into Lodsys patent claim

Apple is said to be "actively investigating" the patent claims made by holdings firm Lodsys, which last week began sending a handful of developers notices that their apps were infringing on a patent the group held, The Guardian reports.

Just yesterday Lodsys posted a series of frequently asked questions, along with corresponding answers to its blog, wherein it detailed how its patent pertains to the in-app purchase feature of iOS, and the developers who use it. The group seeks an ongoing, revenue-based licensing fee, as well as back payment on apps that make use of the feature. Wholesale Battery

So far Lodsys has not made mention of how many developers it's sent notices to. Those who received letters from the group last week noted that Lodsys was giving them just 21 days to license their use of in-app purchase with the threat of legal action if they didn't. wholesale baby monitor

In yesterday's FAQ the group said it was effectively going after all apps that make use of IAP, no matter if the company was big or small. Lodsys' claims could have a considerable impact on the appeal of developing on the iOS platform. While app makers are expected by Apple to secure the rights to trademarks, copyrights, patented technology, and any other intellectual property within their applications, Lodsys is going after developers for something Apple has built into its own mobile operating system. Lodsys wrote in its missive that Apple's current license for the technology doesn't allow it to pass that on to app makers who then sell on its platform. Rambus, SAP, Teva Pharmaceutical, Microsoft, Apple: Intellectual Property

The patent covers software that can help sales staff determine the most recent price for products and services. Walldorf, Germany-based SAP told jurors that customers weren’t buying its software for that feature, so any patent royalties should be low.

“This has been four hard fought years, and the evidence clearly shows that SAP’s use of our intellectual property caused harm,” Cole said. “It was a valuable invention.”

SAP said it’s disappointed with the judgment and is considering whether to appeal.

“We have said all along this is a very complex case,” Andy Kendzie, a company spokesman, said in a telephone interview. “Our attorneys are reviewing today’s filing and we will consider all legal options.”

Teva, Mylan Anchen Win Patent Ruling Over Amrix Infringement

Teva Pharmaceutical Industries Ltd. (TEVA), Mylan Inc. and Anchen Pharmaceuticals Inc. won a case involving their planned generic version of the muscle-relaxant Amrix.

Cephalon Inc. (CEPH) and Eurand NV (EURX) sued for patent-infringement in 2008 in federal court in Delaware. U.S. District Judge Sue Robinson on May 11 decided that the patents aren’t valid because the technology would be obvious to a skilled chemist. wholesale car accessories

“Cephalon is reviewing the court’s opinion and is evaluating its options, including an appeal,” the company said May 13 in a U.S. Securities and Exchange Commission filing.

Teva, the world’s largest generic-drug maker, said on May 2 it agreed to buy Cephalon for about $6.2 billion.

Cephalon and Eurand filed the lawsuit after the generic drugmakers applied to the U.S. Food and Drug Administration for permission to make low-cost copies of Amrix. The companies had conceded that their version of the formula infringed and claimed the patents weren’t valid. wholesale ebook reader

Microsoft, Nokia Challenge Apple’s ‘App Store’ EU Trademark

Microsoft Corp. (MSFT) and Nokia Oyj (NOK1V) are among four technology companies challenging Apple Inc. (AAPL)’s European Union-wide trademarks for “Appstore” and “App Store.” wholesale netbook shop

Nokia, the world’s largest mobile-phone maker, Microsoft, Sony Ericsson Mobile Communications AB and HTC Corp. (2498) all filed separate requests May 12 with the EU trademark agency in Alicante, Spain, seeking to invalidate Apple’s trademark rights.

The companies “are seeking to invalidate Apple’s trademark registration for ‘APP STORE’ and ‘APPSTORE’ because we believe that they should not have been granted because they both lack distinctiveness,” according to a statement from Redmond, Washington-based Microsoft, the world’s largest software maker.

A decision by the agency could be appealed all the way to the EU’s top court in Luxembourg. Apple, which pioneered the sale of mobile-device applications, accounts for more than three-quarters of revenue in the industry -- even as Google Inc. (GOOG)’s app sales grow faster. Apple’s App Store offers more than 350,000 apps for iPhones, iPods and iPads. It will bring in $2.91 billion in revenue in 2011, up 63 percent from last year, according to researchers at El Segundo, California-based IHS ISuppli.

Amazon.com Inc. (AMZN) on April 15 opposed Apple’s two EU trademarks, according to documents on the trademark agency’s website. The dispute over the validity of the Apple rights has also reached the U.S., where Amazon, after being sued for trademark infringement by Apple, argued the intellectual property right was invalid.

Alan Hely, a U.K.-based spokesman for Cupertino, California-based Apple, declined to comment, saying the company doesn’t comment on pending litigation.

Mark Durrant, a spokesman for Espoo, Finland-based Nokia, and Sony Ericsson spokeswoman Mandy Slater confirmed the companies also objected to the trademark registration.

The phrase “means just what it says, a store for ‘apps,’ which in itself is a generic term for the services that the trademark registrations cover,” Durrant said in an e-mail.

Sony Ericsson Says Trademark Litigation With Clearwire Resolved

Sony Ericsson Mobile Communications AB and its U.S. unit Sony Ericsson Mobile Communications Inc. reported on May 13 the resolution of trademark litigation initiated against Clearwire Corp. (CLWR) and its primary operating unit, Clearwire Communications LLC.

The litigation involved Sony Ericsson’s contention that Clearwire was using logos which infringed Sony Ericsson’s trademark.

Google's choice: Chrome OS or Android?

Google isn't the only big tech company with two operating systems. But it's the only one with two that take such a different approach. Wholesale Battery


Android and Chrome OS each got a day to themselves here at Google I/O a conference designed to fire up programmer interest in Google's technology.

With the new Android 3.1, an update to the tablet-centric Honeycomb version, Google yesterday added the ability for people to plug in keyboards, mice, game controllers, and many other USB and Bluetooth devices. In short, it's making the tablet more into a PC, architecturally speaking. Wholesale Computers

But today, the news was all about Chrome OS, a browser-based operating system that transforms new laptops from Samsung or Acer into vessels for Web applications.

Two days, two philosophies. In one, the device in front of you runs the applications natively, a method that would be old school except that new smartphones are powering an explosion of new programmer interest. The other is the ultimate expression of cloud computing, where a server at the other end of the network is running the show and you just have a powerful remote control.

Google, though, thinks there's room for both. There's no cage-match-to-the-death, two-will-enter-but-only-one-will-come-out-alive approach, Google co-founder Sergey Brin said while talking to reporters today after Google announced the first Chrome OS laptops.

"It's a great dilemma to find ourselves with two fantastic successes on our hands," Brin said, perhaps a little grandly given that the Chromebooks won't even ship until June 15 much less prove themselves a success. "We'd consider ourselves fortunate to have either Android or Chrome OS," he added, implying that instead it has an embarrassment of riches.


Acer Chromebook: Google's take on the Netbook

(Credit: Acer) The company's biggest rivals also have two operating systems. Microsoft has Windows and now Windows Phone 7 for mobile devices. Apple has Mac OS X and iOS. Though there are some synergies here and there--perhaps more as ARM-based computers spread and as the mobile OSes grow up--those operating system projects are separate.

But they're still philosophically similar: a device with a processor, input hardware, and an output display is at the center of its own little universe. Google has a much more distributed view of the world.

Of course, even with Android, the cloud is important. It's intended to be a conduit to Gmail, Google Docs, and other Net-based services. Android is intended to accelerate the mobile-computing revolution, a job it's doing well (with Apple leading much of the charge), so part of its purpose is to link to a server.

With Chrome OS, the cloud isn't just important, it's almost all there is. You can use local files--view PDFs, play music, watch videos--but those features are more necessary evils than the heart of the experience. Google makes sure that when you plug a camera into the USB port, you can quickly transfer the photos to Picasa Web Albums.

Sundar Pichai, senior vice president of Chrome, argues that Android and Chrome OS provide "different, unique computing experiences."

"It's a very different model," Pichai said, pointing out that each reporter in the press Q&A had both a phone and a laptop. "We want to provide that choice to users and developers alike." wholesale baby monitor

He has a point. Mobile phones don't have enough processing power to handle the highly abstracted mechanisms browsers provide for fancy graphics. And Web sites and Web apps often work poorly if at all on smartphones' small touch screens. So there's a big role for native apps are more. wholesale netbook shop

But things are quite as simple as saying Google offers different tools for different circumstances. Android and Chrome OS are headed to similar hardware realms.

Another complication: app stores. Do people who've bought an Android game in the Android market have to re-purchase it through the Chrome Web Store? Angry Birds is available in both, and it's safe to expect others to cross the divide.

Finally, there's the developer issue. Google must evangelize two separate, incompatible ecosystems. It has to produce development tools for each, too.

Overall, though, if any company can hold two such different ideas in its head at the same time, it's Google. The company loves programmers, and judging by how packed to the gills Google I/O is, a fair number of them love Google. And regardless of the fortunes of Chrome OS and Android, programmers will be writing for both types of operating systems. LASER POINTERS


That's because Web programming is a major force today, regardless of Chrome OS, and mobile apps are a major force today, regardless of Android. Both methods will thrive in coming years. Even if supporting both muddies the waters for Google's priorities and messaging, they're not mutually exclusive.

Microsoft nears $8.5 bn Skype buy in web shift

This change was starkly illustrated last year when Apple's portfolio of coveted consumer goods propelled it past Microsoft to become the world's most valuable technology company. The Skype deal -- which would be the biggest in the 36-year history of the world's largest software company -- is expected to be announced as early as Tuesday morning, the source told Reuters. Microsoft and Luxembourg-based Skype declined comment. Wholesale Computers

The $8.5 billion mooted price tag, including debt, was a surprise. Although the sum would not stretch cash-rich Microsoft, some said it was high for a company whose ownership has changed several times during its relatively short life.

"In this atmosphere of Internet Bubble 2.0, picking up an unprofitable online company for roughly 10 times sales probably seems downright cheap," Shanghai-based Michael Clendenin, managing director of consulting firm RedTech Advisors, said.

"But if you consider (it) was just valued at about $2.5 billion 18 months ago when a chunk was sold off, then $8.5 billion seems generous and means Microsoft has a high wall to climb to prove to investors that Skype is a necessary linchpin for the company's online and mobile strategy," he added. This was echoed by Ben Wood, head of research firm CCS Insight: "The big unanswered question is how do Skype assets work for Micrososft, they already have instant messaging, IP telephony...how do you justify the price?"

Skype, which delayed plans for an initial public offering expected to raise $1 billion, has been looking at other options, including tie-ups with Facebook and Google. Such a deal was seen as valuing Skype at $3 billion to $4 billion.

Asus Eee Pad Transformer TF101

When I first turned the Transformer on, I noticed immediately some pleasant user-interface improvements that Asus made to stock Android 3.01.Wholesale Battery


For starters, the core navigation buttons are dramatically better. Asus replaced the standard Honeycomb nav buttons (three light-blue outlines that serve as the primary navigation aids at the lower left of the screen) with three white, solid button formations that are crisp and distinct. In particular, the back/exit button, better represents its function with a looping return arrow--an improvement on the stock Honeycomb's chintzy back arrow that looks more like a bookmark symbol.

Another big change involves the Asus keyboard. The stock gray Honeycomb keyboard is available as an option, but by default the Transformer uses Asus's own keyboard, which features a lighter gray background and dark, well-defined letters and numbers. The redesigned keyboard has a row of number keys up top; and keys in both the number row and the first letter row are slightly taller than the ones on rest of the keyboard. The keyboard appears to occupy about the same depth as the stock Honeycomb keyboard, but with the added benefit of the number row (a native first among the Android 3.0 tablets). The keyboard incorporates Google's predictive text, too, another native first for an Android 3.0 tablet. Wholesale Computers Unfortunately, this feature behaved a bit unpredictably in my testing. For example, it didn't work consistently when filling in fields in the Web browser. Also, the keyboard sacrifices some of its QWERTYness--by having its Z and S keys stacked, for example. On the whole, the keyboard was responsive.

In addition to introducing these adjustments, Asus provides a small selection of its own Android widgets to use in customizing the front face to dictate how you access your data. For example, you can get a large, friendly weather update; or choose My Zine widgets that present your photos, weather, and recently accessed Web, music, and book content in a fresh way. The approach is similar to--but not as far reaching as--Acer's handling of its Iconia Tab A500, where widgets appear as additional app icons primarily to create a sense of categorized folder hierarchy for your apps (Android 3.0 doesn't have folders, as Apple's iOS does). Asus's approach isn't as far-reaching as Samsung's TouchWiz interface on the 7-inch Android 2.2 Galaxy Tab or HTC's Sense UI overlay planned for its 7-inch Flyer. According to Asus, by omitting an extra overlay, the company can respond faster to OS updates as they come available from Google.LASER POINTERS

Asus also provides a couple of custom wallpapers, including the interactive MyWater wallpaper that reacts to the motions of the built-in gyroscope, and shows the battery level by changing the water level in the wallpaper. In use, the Transformer felt about as zippy (and as sluggish) as I've come to expect from the current crop of Tegra 2 tablets, depending on the activity. Its camera was actually slightly faster on the trigger than the ones on other Android 3.01 tablets I've used--but still pokey as molasses. This version of Android has image and text rendering issues, too, as its predecessors did. Images aren't rendered sharply and with good detail in the Android Gallery, and text appears to be insufficiently antialiased. Android 3.01 hasn't yet received a major update; one can only hope that these issues and others will be fixed in the future.

The Transformer comes preloaded with useful software. wholesale baby monitor Some apps are unique to Asus: Asus's MyNet DLNA media sharing app; MyCloud for accessing Asus's Webstorage (2GB free for one year; unlimited storage for $5 monthly) or for connecting remotely to your desktop via the Splashtop-powered MyDesktop; MyLibrary for accessing newspaper, .Epub, and PDF book content. Google’s Plan To Win Location & Social

Mayer said that Google Maps has been quickly evolving from its desktop roots into a mobile-focused experience. In fact, during weekends, Google Maps via mobile receives more traffic than the desktop.

Mayer also announced new products that she said exemplify Google’s core strategy of bringing interactivity, discovery and new perspective to local: Google Business Photos for Maps and Google Earth for Android tablets.
Mayer played coy during a discussion of Google Offers. She said Google’s Groupon competitor “does not exist,” but elaborated by saying that Google is looking at the offers space, talking with businesses and trying to figure out what approach it should take in the group buying space.LASER POINTERS

Battelle compared the exploratory process to being in pre-production for a film.

During a Q&A, Federated Media’s John Battelle asked Mayer about Google’s recent reorganization. He asked her what’s changed now that Larry Page is CEO and what it’s like now that “there is a new sheriff in town.”

More Speculations about Apple iCloud

There is lots of talk about iCloud, which is said to be Apple’s new cloud service. People have already speculated that it would be better than the cloud services from Microsoft, Google, and Amazon.
